1. Our Contract

1.1 These Terms and Conditions govern the supply of goods sold via this website by Mean and Green ("we" and "us") to the customer named on an order ("you") placed on this website. Together with the completed checkout process, these Terms and Conditions constitute the entire and only agreement between us in relation thereto. Our acceptance of your order by delivery of the goods constitutes a legally binding contract between us on these terms and conditions.

2. Price and Payment

2.1 The price payable for the goods you order is as set out on this website at the time you place your order plus any charges for carriage and insurance as set out in this website. We must receive payment for the whole of the price of the goods you order, and any applicable charges for carriage and insurance, before your order can be accepted unless we have agreed otherwise in advance in writing. If an error is discovered in the price of the goods that you have ordered, we will inform you as soon as possible. We shall be under no obligation to fulfil an order for a product which was advertised at an incorrect price.

2.2 All orders should be paid for with a credit or debit card, either used on this website or on the phone. We can accept cheques drawn on a UK bank (made payable to "Mean and Green") but please note that there can be up to 3 weeks delay while we wait for them to clear through our system and the bank's system. Postal orders incur no delay. Please ensure you provide a phone number on any orders sent through the post in case we have any queries.

3. Delivery and Title

3.1 We will deliver your goods in accordance with your order. A valid signature may be required on collection or delivery.

3.2 Immediately prior to despatch of the goods to you, title in the goods will pass to you. In the unlikely event that you have not received all the goods within 14 days of the date of despatch (25 days for non-UK addresses), you must notify us immediately.

3.3 We are unable to accept any instruction to leave your order somewhere unattended, e.g. behind bins.

3.4 Guaranteed delivery services apply only to those items shown as in stock in your basket. If only some of your items are in stock, then we will send the in-stock items by your chosen shipping method, and the remaining items will be delivered for free by our standard method as soon as they come back in stock. Whichever option you choose, you only ever pay one shipping charge per order. Our guaranteed delivery services mean that if we fail to deliver on time, then we will refund the shipping fee in full. No claims for consequential loss can be accepted. No despatches or deliveries are made on UK public holidays.

3.5 If you refuse acceptance of a delivery then any fees incurred by us due to the return of the consignment will be charged to the card used when you placed your order. If an order is returned due to non-delivery or non-collection and you ask us to re-send, then we will charge the same postage amount as paid on the original order.

3.6 We reserve the right to quote an additional amount for postage when sending heavy or bulky items, especially when sending outside the UK. In such circumstances, you will be contacted prior to us proceeding with your order.

3.7 It is your responsibility to make all reasonable efforts to enquire into the whereabouts of a despatched order and collect from any holding agent or customs department. Cards are usually left to advise of an attempted delivery, but this is not always the case so enquiries should always be made. Postage charges cannot be refunded on orders returned to us as addressee incomplete or not called for.

4. Availability

4.1 While we endeavour to hold sufficient stock to meet all orders, if we have insufficient stock to supply or deliver the goods ordered and paid for by you, we may, at our discretion, supply or deliver a substituted product or cancel your order.

4.2 We strive to provide accurate descriptions and photos of all products on this website. However, the exact design, colour, etc of some items (especially genuine surplus) may occasionally differ from that shown on this website. If the exact shade of colour is of particular importance to you, then please contact us before ordering to discuss.

4.3 Quantities and measurements are approximate. Sizes in particular are approximate and are given as guidance only to assist in your purchasing decision. Manufacturers often produce garments to within a tolerance level of the size quoted or shown on the label.

4.4 Where an item is listed as used, then we cannot guarantee its cosmetic condition, but we strive to ensure all items are fully functional, e.g. do not have any rips or holes, etc.

4.5 Some of our products are sold by and fulfilled by Amazon on our behalf. Further, as an Amazon Associate we earn from qualifying purchases.

5. Cancellation and Returns

5.1 Please view our separate returns policy which also forms part of these terms and conditions.

6. Liability

6.1 Any problems with your order must be notified to us within 30 days of receipt of the goods. We will either make good any shortage or non-delivery; replace or repair any goods that are damaged or defective upon delivery; or refund to you the amount paid by you for the goods in question. We will not be liable to you for any loss of profits, administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the goods and we shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions. This does not affect your statutory rights as a consumer. We are unable to reimburse any postage costs incurred when returning items to us. If we have sent an incorrect item then we may provide a pre-paid returns label or reimburse postage costs up to a maximum of £5 if agreed in advance.

7. Termination

7.1 We reserve the right to refuse or cancel any order without providing an explanation of our reasons for so doing.

7.2 We may suspend further supply or delivery, stop any goods in transit or terminate our contract by notice in writing to you if you are in breach of an obligation hereunder or you become unable to pay your debts when they fall due or proceedings are commenced by or against you alleging bankruptcy or insolvency. Upon termination, your indebtedness to us becomes immediately due and payable and we shall be under no further obligation to supply goods to you.

8. Force Majeure

8.1 We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, without limitation, strikes, lockouts and other industrial disputes).

9. VAT

9.1 Where applicable, prices include VAT at the prevailing rate. VAT no. 841712737.

10. Age Requirements for Specific Goods

10.1 Where the law requires a minimum age limit for the purchase of specific goods, you confirm that you are over the required age limit and that delivery will be accepted by a person over the required age limit.

11. Legal Restrictions on Specific Goods

11.1 It is your responsibility to check that any item you order is legal within your jurisdiction. We can accept no responsibility for any loss due to seizure of goods by authorities. Particular attention should be paid to the purchase of knives, ammunition, weapons, etc.

11.2 Surplus protective equipment (e.g. gas masks) are sold as collectors items only and we provide no warranties whatsoever as to their use or function.

12. Import Duties

12.1 You will be responsible for paying any duties, taxes and other fees applicable when the goods are imported into another country. Please do not ask us to mark your shipment as a gift on the Customs form, as this could constitute an offence which could leave us liable to prosecution.

13. Design and Reproduction

13.1 Photographs, drawings, part numbers, layout and style are considered property. Reproduction in whole, or in part, is strictly prohibited without written permission. Trademarks acknowledged. Exact products may vary from that shown. All products subject to availability.

14. General

14.1 If any part of these conditions is invalid, illegal or unenforceable (including any provision in which we exclude our liability to you) the validity, legality or enforceability of any other part of these conditions will not be affected. This contract shall be governed by and interpreted in accordance with English law.
